The Spanish version of these Terms is the official legal text. This English translation is provided for convenience. If there is any conflict, the Spanish version prevails.
1. INTRODUCTION AND ACCEPTANCE
Welcome to EresFitness. These Terms and Conditions of Use (the "Terms") govern access to and use of:- The Eres Fitness Woman mobile application (the "App", "platform" or "service"), available on the Apple App Store and Google Play Store.
- The website https://mujer.eresfitness.com and related domains, including eresfitness.com (the "Website").
LEGAL NOTICE: BY ACCESSING, DOWNLOADING, INSTALLING OR USING ANY PART OF THE PLATFORM, YOU (THE
"USER") EXPRESSLY AND UNRESERVEDLY ACCEPT THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MUST STOP
USING THE PLATFORM IMMEDIATELY.
This agreement is a legally binding contract between you and EresFitness ("we", "our" or the
"Company"), governed by the laws of the United Mexican States.
2. MEDICAL AND HEALTH DISCLAIMER
READ CAREFULLY: YOUR HEALTH IS YOUR RESPONSIBILITY.2.1. Not a Medical Service
The Platform, including all content (text, images, exercise videos, routines, nutrition plans, calculators, charts and recommendations generated by artificial intelligence), is provided for informational, educational and entertainment purposes only.- We are not doctors, certified nutritionists or physical therapists.
- The content is not medical advice, diagnosis, therapy or treatment.
- Nothing on the Platform replaces professional medical consultation.
- Plans, calorie goals and support-assistant answers are generated automatically and may contain errors. You must use your own judgment and consult a health professional.
2.2. Prior Physical Condition
You acknowledge that physical exercise involves inherent risk of injury. By using the Platform, you represent that:- You are in good physical and mental health.
- You have consulted a doctor before starting any exercise program or diet changes suggested by the Platform.
- You have no cardiovascular, respiratory or musculoskeletal conditions that prevent physical activity.
2.3. Assumption of Risk
You assume full responsibility for any injury, damage, health impact or death that may arise from use of the Platform. EresFitness, its owners, employees and affiliates disclaim civil or criminal liability for direct or indirect damages related to the workouts provided.2.4. Apple Health and Health Connect sync
If you enable sync with Apple Health or Health Connect, you control those permissions on your device. The Company does not guarantee the accuracy of imported or exported data and is not responsible for information that remains on those third-party platforms.3. USE OF THE WEBSITE AND APP
3.1. Eligibility
To use the Platform, you must:- Be at least 18 years old and have full legal capacity to contract under Mexican law.
- If you are between 16 and 18, have express authorization and supervision from a parent or legal guardian.
- Not have been previously suspended or removed from the Service.
3.2. License
We grant you a limited, non-exclusive, non-transferable, revocable and personal license to access and use the Platform for personal, non-commercial purposes only.- Website: Browsing, reading articles, onboarding, web account and viewing public content.
- App: Download, install and use the fitness tracking tools on your mobile device.
3.3. Restrictions
You must not:- Copy, modify, distribute, sell or lease any part of our Services or software.
- Reverse-engineer or attempt to extract the source code (except as allowed by law).
- Use the Platform to transmit malware, viruses or harmful code.
- Scrape the Website or the App.
- Circumvent any security measure or technical restriction.
- Abuse the artificial-intelligence, support, community or reporting features.
4. ACCOUNTS AND REGISTRATION
To access certain features (such as saving workout history), you must create an account. You may start with an anonymous session and later link Google, Apple, Facebook or email.- Accuracy: You agree to provide real, accurate and up-to-date information when asked.
- Security: You are solely responsible for safeguarding your password and device access. EresFitness is not liable for losses from unauthorized use of your account.
- Notice: You must notify us immediately through our support channels of any security breach of your account.
- Web account: The Website may use the same Firebase account. A session cookie
(
efw_auth) keeps you signed in to the dashboard. - Deletion: You can delete your account in
Options > About > Delete my account. This action is irreversible and does not by itself cancel an App Store or Google Play subscription.
5. PREMIUM SUBSCRIPTIONS, TRIALS AND PAYMENTS
5.1. Plans
We offer a free version (with ads and limitations), trial periods when available, and a "Premium" subscription (no ads and advanced features, including AI plan generation).5.2. In-App Purchases
Subscriptions and trials purchased in the App are billed by the app stores (Apple App Store or Google Play Store).- Contract: Your transaction is with Apple or Google, not directly with EresFitness.
- Prices: Prices are shown in your store's local currency and include applicable taxes according to that store and your jurisdiction.
5.3. Auto-renewal
Under store policies, the subscription (including a trial that converts to a paid plan) renews automatically at the end of each cycle (weekly, monthly, yearly or another offered term) unless you cancel at least 24 hours before the renewal date. The charge is made through your store account.5.4. How to cancel
Cancel in the App Store or Google Play subscription settings. Deleting the App or the account does not cancel auto-renewal.5.5. Refunds
- App Store (iOS): EresFitness cannot issue refunds. You must request them from Apple.
- Google Play (Android): Refunds follow Google Play policies. In exceptional cases and at our discretion we may review requests sent to support, but we are not obliged to grant them.
- Website: If direct Website payments are enabled in the future, the withdrawal right under Mexico's Federal Consumer Protection Law (LFPC) will apply, unless the digital service has already started (immediate access to the content).
6. INTELLECTUAL PROPERTY AND ARTIFICIAL INTELLIGENCE
6.1. Copyright
All Platform content (Website and App), including but not limited to source code, logos, texts, graphics, images, exercise videos, audio, data compilations and look and feel, is owned by EresFitness or its licensors. It is protected by Mexico's Federal Copyright Law and international treaties.6.2. Trademarks
"EresFitness", the logo and other distinctive signs are our trademarks. Use without our prior written consent is prohibited.6.3. AI-generated content
Plans, texts or recommendations generated by artificial intelligence are provided for your personal use on the Platform. You do not acquire rights in the underlying models, prompts or systems. You are responsible for reviewing the output before following it.7. USER-GENERATED CONTENT
By uploading progress photos, creating custom routines, posting in the Community (posts, comments, replies), liking content or sharing workout data in the App, you:- Keep copyright in original content you create.
- Grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify and display that content inside the Platform to provide the service.
- Warrant that the content does not infringe third-party rights and is not offensive, illegal or pornographic.
- Accept that your username, nickname and profile photo will be embedded in each post and comment and visible to all users of the App.
- Accept that images uploaded to Community posts will be stored on our servers (Firebase Storage) and accessible to all users while the post exists.
7.1. Visible results sharing
The App can generate shareable images of your workout stats and routine reports.- You are solely responsible for how you use those images and where you share them (e.g. Instagram, WhatsApp, X).
- These images may include your username, profile photo and physical-performance data.
7.2. Workout data shared in the Community
The App lets you voluntarily share workout reports and training days in the Community.- Sharing a report or training day may publish calories burned, duration, completed exercises, plan name and day number.
- This information is visible to all App users and you are solely responsible for choosing to share it.
7.3. Deleting your content
You can delete your own posts and comments at any time in the App. Deleting a post also deletes associated comments and stored images. Requesting account deletion removes all Community content you created.7.4. Contacts
If you use find-friends from contacts, only email hashes are processed. You represent that you are authorized to use that data for this purpose.8. SOCIAL FEATURES, COMMUNITY AND GLOBAL LEADERBOARD
EresFitness includes features to foster community and healthy competition.8.1. Leaderboard
When you use the App, your progress (experience points, level, consistency) may appear on a Global Ranking visible to other users.- Your Username and Profile Photo will be public in the ranking.
- You can choose not to appear on the ranking from your profile settings.
8.2. Follows and friendships
Users may follow each other, add friends or block others.- When you follow someone or are followed, some profile information becomes visible to that person.
- You can mark your profile as private and block other users.
8.3. Community feed
The App includes a Community section where users interact through posts, comments and likes.- Posts: You can create text posts with or without images, visible to all App users.
- Comments and replies: You can comment on other users' posts and reply to existing comments.
- Likes: You can like posts and comments. Your user identifier is stored to count interactions.
- User search: You can search users by name or nickname. Recent searches are stored locally on your device.
8.4. Community conduct
When using the Community, you agree to:- Not post offensive, defamatory, discriminatory, sexually explicit, violent or illegal content.
- Not harass, threaten or intimidate other users.
- Not post spam, unauthorized commercial content or malicious links.
- Not impersonate other people or entities.
- Not post third-party personal information without consent.
- Respect third-party intellectual-property rights in images and texts you post.
- Comply with all applicable laws in your jurisdiction.
8.5. Content moderation
EresFitness reserves the right, without prior notice and at its sole discretion, to:- Hide posts or comments it considers inappropriate or in violation of these rules.
- Delete posts, comments and images that violate these Terms or applicable law.
- Suspend or cancel accounts of users who repeatedly breach community rules.
8.6. Reporting
Users can report posts they consider inappropriate through the in-app reporting system.- Available reasons include inappropriate content, spam, harassment and others.
- Reports are reviewed by our moderation team and we will take the actions we consider appropriate.
- EresFitness is not obliged to notify the author of reported content about the action taken.
- Abusive or bad-faith use of reporting may result in account suspension.
8.7. Third-party content disclaimer
EresFitness does not control, warrant or assume any liability for content published by users in the Community, including its truth, accuracy, legality or safety. You interact with other users and their content at your own risk.9. SUPPORT, COMMUNICATIONS AND THIRD-PARTY LINKS
The App may include an automated support assistant. Its answers are guidance only, do not replace a person and are not medical advice. We may review conversations when needed for safety or to escalate your case to a human. We may send you push notifications, in-app messages and transactional or promotional emails. You can turn off promotional email and push notifications in the App or device notification settings. The Website or App may contain links to third-party sites (e.g. external health articles, advertisers, analytics services such as Microsoft Clarity, Apple Health or Health Connect). We do not control and are not responsible for the content, privacy policies or practices of those sites. Access is at your own risk.10. LIMITATION OF LIABILITY
To the maximum extent permitted by Mexican law:- "As is" service: The Platform is offered without warranties of uninterrupted availability or freedom from errors.
- Indirect damages: EresFitness is not liable for lost profits, data loss, moral damages or consequential damages arising from use or inability to use the Service.
- Monetary cap: In no event will EresFitness's total liability to you exceed the amount you paid the Company in the last six (6) months, or MXN $1,000.00 (one thousand Mexican pesos), whichever is greater.
11. GOVERNING LAW AND JURISDICTION
11.1. Governing law
These Terms are governed by and construed in accordance with the federal laws of the United Mexican States, including the Federal Civil Code, the Commercial Code and the Federal Consumer Protection Law.11.2. Jurisdiction
For any dispute arising from these Terms, the parties expressly submit to the courts of Mexico City, waiving any other venue that may correspond by reason of their present or future addresses.12. CHANGES TO THE TERMS
We may modify these Terms at any time.- Notice: We will publish the updated version on the Website and in the App. For material changes we will try to notify you by email or in-app notice.
- Acceptance: Continued use of the Platform after publication constitutes tacit acceptance of the new Terms.
